Come on America. Let's be honest--Republicans, Democrats. Liberals, Conservatives. Proud Boys and ANTIFA. Does anyone really take these robed political activist seriously, anymore?
Writer Eric Segal, in his 2014 article at Slate Magazine says, "... recognize that we have unelected, life-tenured politicians masquerading as judges, making important decisions that affect us all. It is important to recognize the court for the purely political institution it is, and to acknowledge that it is not a court of law, in order to have a serious debate about a number of other issues."
And what could be a more important issue than this current battle being waged between Republicans and Democrats trying to claim the ultimate political prize for their candidate, at least for the next four year; the Presidency of the United States.
In his article, Segal quotes Judge Richard Posner, recognized as "the most cited legal scholar of the last 20 years." Segal outlines how this judge argues in his book How Judges Think, that "the Supreme Court is a “political court” different in degree than other courts for many reasons, including that it defines its own caseload, picks the most politically charged cases, and pretends to make decisions based on vague text and contested history, when in fact what the justices are doing is deciding cases based on their personal values."
Judge Posner makes some valid points, however many probably would disagree with his comment that "what the justices are doing is deciding cases based on their personal values." In today's electrified political atmosphere, this current crop of Lawyers in fancy black robes, seem to be less inclined to even consider the Constitution when making rulings in major cases, and more apt to decide those cases based on their IDEOLOGICAL indoctrination.
Based on their speedy decisions in issues surrounding the legitimacy of our November 3rd Presidential election, many frustrated Americans might be inclined to believe that President Trump probably would stand a better chance in the court of public opinion rather than a so-called formal hearing from this Kangaroo court, which appears these days to be ignoring the Constitution itself, practicing their own brand of justice, "which intentionally disregards the court's legal or ethical obligations."
Supreme Court Justice Sonia "Wise Latina" Sotomayor was explicit that she values feelings over the law, stating "I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn't lived that life."
Note to Donald Trump. With fair-minded legal wizards like Sotomayor hearing legal arguments which will determine the fate of retaining the United States Presidency, one can only hope your resume is current, and Allied Van Lines is highly prioritized on your smartphone speed dial.
It's time for the Supreme Court to take their heads out of the sand, and do their job.
